Yappigo Terms of Service

1. Agreement and service provider

These Terms of Service form an agreement between you and Together North Inc., the company that operates the Yappigo mobile application, website and related services. In these Terms, “Yappigo,” “we,” “us” and “our” refer to Together North Inc. when operating the Yappigo service. By creating an account or using Yappigo, you agree to these Terms and the Yappigo Privacy Policy. If you do not agree, do not use the service.

2. Pre-launch status

Yappigo is currently in development. Website descriptions explain intended features and may change before launch. Waitlist registration does not guarantee access, a launch date or the availability of a particular feature.

3. Eligibility

You must be at least 13 years old and legally capable of agreeing to these Terms. If the law where you live requires parental or guardian consent, you may use Yappigo only after that consent has been obtained.

4. Your account

• Provide accurate and reasonably complete account information.
• Keep your login credentials confidential.
• Use only your own account and do not share access credentials.
• Notify us promptly if you suspect unauthorized access.
• Accept responsibility for activity conducted through your account unless applicable law provides otherwise.

The My Account website portal will allow you to manage only your Yappigo account after the portal is connected to the app account database. It will not create a separate WordPress account.

5. Pet care information is not veterinary advice

Yappigo helps users organize and share information. It does not provide veterinary diagnosis, treatment or emergency services. Information in Yappigo may be incomplete, outdated or entered incorrectly by a user. Always consult a qualified veterinarian for medical advice and contact an appropriate emergency service when an animal may be in danger.

6. Free app and optional payments

Yappigo intends to make all regular end user pet care features available in the free app. Users may have the option to pay to remove advertising. Paying to remove ads will not unlock or limit pet care features. The advertising approach has not yet been finalized.

Apple, Google or another disclosed payment provider may process purchases. Billing, cancellation and refunds may also be governed by that provider’s terms and applicable consumer law. Prices, taxes and renewal details will be shown before a purchase is completed.

7. Future pet sitter marketplace

A marketplace for pet sitters or other pet related services may be introduced after the initial launch. Marketplace participation may involve service fees or transaction fees that are separate from regular end user app features. Any price will be disclosed before a transaction.

Unless Yappigo expressly states otherwise, service providers and customers contract directly with one another. Yappigo does not guarantee the identity, qualifications, insurance, conduct, safety, legality or quality of a marketplace participant or service. Additional marketplace terms, screening practices and dispute procedures may apply before that feature launches.

8. Your content

You retain ownership of pet profiles, photos, videos, posts, documents and other content you upload. You grant Together North Inc. a non-exclusive, worldwide and royalty-free licence to host, store, copy, process, display and transmit that content only as reasonably necessary to provide, secure and improve Yappigo, comply with your sharing choices and meet legal obligations.

You are responsible for having the rights and permissions needed to upload content. Do not upload unlawful, harmful, misleading or infringing material, or personal information about another person without authority.

9. Family circles and shared access

You control whom you invite to a private circle and the permissions you provide. People with access may see or change information according to their assigned role. Review access regularly and remove anyone who should no longer participate. Yappigo is not responsible for disagreements among family members, co-parents, caregivers or sitters, subject to applicable law.

10. Prohibited conduct

• Harass, threaten, impersonate or harm another person.
• Upload illegal, abusive, deceptive or infringing content.
• Access another account or system without authorization.
• Introduce malware or interfere with the service.
• Scrape, harvest or extract Yappigo data using automated tools, bots or artificial intelligence systems.
• Reverse engineer, decompile or attempt to obtain source code except where the law expressly permits it.
• Use Yappigo for unauthorized advertising, solicitation or commercial activity.
• Use the service in a way that violates animal welfare, privacy, intellectual property or other applicable laws.

11. Yappigo intellectual property

Yappigo’s software, branding, trademarks, interfaces and original design elements belong to Together North Inc. or its licensors. These Terms provide a limited, personal, revocable and non-transferable right to use the service. They do not transfer ownership of Yappigo intellectual property.

12. Suspension, termination and deletion

We may restrict, suspend or terminate access when reasonably necessary to address a serious or repeated violation of these Terms, fraud, abuse, security risk, legal requirement or risk of harm. Where appropriate, we may provide notice and an opportunity to correct the issue.

You may stop using Yappigo and permanently delete your account. Account deletion will be available inside the app and through the My Account portal when available. Some information may be retained when required by law or reasonably necessary for security, fraud prevention, dispute resolution or legal claims.

13. Availability and third party services

Yappigo may depend on app stores, hosting providers, payment services, device features and internet connections that we do not control. We may modify, suspend or discontinue parts of the service. We will make reasonable efforts to communicate significant changes, but we do not guarantee uninterrupted or error free availability.

14. Disclaimers

To the extent permitted by law, Yappigo is provided “as is” and “as available.” We do not guarantee the accuracy of user supplied information, the outcome of pet care decisions, the conduct of other users or marketplace participants, or that the service will always be available or free from errors. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

15. Limitation of liability

To the maximum extent permitted by law, Together North Inc. and its directors, officers, employees and partners will not be liable for indirect, incidental, special, exemplary or consequential damages, lost profits, lost revenue, lost data, user generated content, pet related outcomes, disputes between users or issues arising from marketplace transactions. Where liability cannot be excluded, total liability relating to the service will not exceed the amount you paid to Yappigo during the 12 months preceding the claim. These limits do not apply where prohibited by consumer protection or other applicable law.

16. Indemnity

To the extent permitted by law, you agree to indemnify Together North Inc. against third party claims and reasonable costs arising from your unlawful use of Yappigo, your content, your violation of another person’s rights or your material breach of these Terms. This section does not apply where prohibited by applicable consumer law.

17. Changes

We may update these Terms to reflect service, legal or security changes. We will update the date above and provide additional notice for material changes. Where the law requires consent to new terms, we will request it. Continuing to use Yappigo after an effective update means you accept the revised Terms where permitted by law.

18. Governing law

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles. Courts located in Ontario will have jurisdiction unless mandatory consumer law gives you the right to bring a claim elsewhere.

19. General provisions

If a provision is found unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver. You may not transfer this agreement without our consent. Together North Inc. may transfer it as part of a merger, financing, reorganization or sale of the Yappigo business, subject to applicable law.
